I am directed by the Lords Commissioners of His Majesty's Treasury to advert to the letter addressed to this Department from the Colonial Office on 5th November last

Live (2610/1910), transmitting a copy of a despatch from the Officer administering the Government of Hong Kong, together with the draft of an Ordinance to consolidate and amend the law relating to Companies, and in reply I am directed to request you to inform the Secretary of State that My Lords agree that it is desirable that Banks should be included within the scope of the Ordinance and They concur in his opinion that Section 2 (1) should be amended by the substi- tution of a subsection in the terms of Section 4 of the Straits Settlements Ordinance No.V. of 1889.

My Lords do not know upon what grounds the Colonial Government propose that existing private banks should be exempted from the requirements of the Ordinance and They think that this point should receive further con- sideration.

I am to express Their Lordships' regret that an earlier answer should not have been returned to Mr. Cox's

letter.
